This Terms of Service Agreement (“Agreement”) is a legally binding agreement between SirWizTechHost (“SirWizTechHost”, “we”, “our”, or “us”) and you (“Customer”, “Client”, “User”, “you”, or “your”). This Agreement governs the use of all hosting services, domain services, cloud infrastructure, VPS services, dedicated servers, offshore hosting, and all related products and services provided by SirWizTechHost.
By purchasing, accessing, or using any of our Services, you confirm that you have read, understood, and agreed to all terms and conditions contained in this Agreement and any related policies including our Privacy Policy and Acceptable Usage Policy (AUP).
By using our Services, you further confirm that you are at least eighteen (18) years old and legally capable of entering into a binding contract under applicable law.
If you do not agree to these Terms of Service, you must immediately discontinue use of our Services and request cancellation of your account.
1.1. The individual or entity listed as the primary account holder or billing contact in our records shall be considered the legal owner of the account and all associated services.
1.2. Customers are responsible for maintaining accurate and updated account information including billing details, contact information, and identification records where required.
1.3. SirWizTechHost reserves the right to request identity verification documents at any time for fraud prevention, compliance, or security purposes.
2.1. The features, limitations, and specifications of the Services purchased are described on the relevant service or product page available on our website at the time of purchase.
2.2. SirWizTechHost reserves the right to modify, upgrade, discontinue, or replace any service, feature, software, or infrastructure component at any time without prior notice.
2.3. Some services may rely on third-party providers, software vendors, registrars, payment gateways, or infrastructure partners. SirWizTechHost is not responsible for changes, interruptions, or limitations caused by such third-party providers.
2.4. We reserve the right to refuse service to anyone for any lawful reason.
3.1. This Agreement becomes effective immediately once you purchase or use any SirWizTechHost service.
3.2. Services are billed according to the selected billing cycle which may include monthly, quarterly, semi-annual, annual, biennial, or triennial terms.
3.3. Unless cancelled before the renewal date, services may automatically renew under the same billing cycle.
3.4. Either party may terminate this Agreement in accordance with the cancellation provisions stated herein.
4.1. All services provided by SirWizTechHost must be used only for lawful purposes.
4.2. Customers may not use our services for activities including but not limited to:
Spam or unsolicited bulk emails
Phishing or fraud-related activities
Malware or virus distribution
Hosting illegal or copyrighted content without authorization
Hacking, cracking, or exploitation activities
DDoS attacks or abusive resource consumption
Hosting extremist or illegal content
Proxy abuse or anonymous relay services
4.3. Customers are fully responsible for all content, files, databases, emails, applications, and activities conducted through their accounts.
4.4. Violation of our Acceptable Usage Policy may result in suspension or termination without refund.
5.1. All services must be paid for in advance unless otherwise agreed in writing.
5.2. Payments may be processed in Nigerian Naira (NGN), United States Dollars (USD), or approved cryptocurrency payment methods.
5.3. Customers are responsible for ensuring that billing information and payment methods remain valid and updated.
5.4. SirWizTechHost reserves the right to modify pricing, fees, or billing structures at any time with reasonable notice.
5.5. Additional fees may apply for overages, upgrades, restoration requests, migrations, advanced support, or custom services.
6.1. Services not renewed before the due date may become suspended automatically.
6.2. Shared Hosting and Reseller Hosting accounts may be suspended after overdue invoices remain unpaid.
6.3. VPS and Dedicated Servers may be powered off or terminated quickly after expiration due to infrastructure allocation requirements.
6.4. SirWizTechHost shall not be responsible for data loss, downtime, or business interruption resulting from suspension or termination due to non-payment.
6.5. Reactivation of suspended services may require payment of outstanding balances and reactivation fees.
7.1. Certain hosting services may qualify for a limited refund guarantee where explicitly stated on the service page.
7.2. No refunds shall be issued for:
Domain registrations, transfers, or renewals
VPS or Dedicated Servers
Software licenses
SSL certificates
Dedicated IP addresses
Setup fees or migration fees
Cryptocurrency payments where prohibited by payment processors
7.3. Refund requests submitted after the eligible refund period may be denied.
7.4. Chargebacks or payment disputes automatically void any refund eligibility.
8.1. Customers must contact SirWizTechHost billing support before initiating a chargeback or dispute.
8.2. Any chargeback or payment reversal may result in immediate suspension of all associated services.
8.3. SirWizTechHost reserves the right to charge administrative fees for chargebacks and dispute handling.
8.4. Fraudulent chargebacks may be reported to financial institutions, fraud databases, or legal authorities.
9.1. Customers may cancel services through the client portal before the next renewal date.
9.2. Cancellation requests submitted after invoice generation may not prevent billing for the next cycle.
9.3. Customers remain responsible for cancelling recurring subscriptions through external payment gateways such as PayPal or cryptocurrency subscription systems.
9.4. SirWizTechHost reserves the right to terminate services immediately for abuse, fraud, policy violations, or threats against staff members.
10.1. Shared hosting environments operate on shared resources including CPU, RAM, disk I/O, and network capacity.
10.2. Excessive resource usage that negatively impacts server stability or other customers may result in temporary restrictions, suspension, or forced upgrades.
10.3. Customers may not use shared hosting accounts as backup storage systems, streaming platforms, or large file distribution systems.
10.4. Outgoing email limits, inode limits, database limits, and process limitations may apply depending on the hosting package.
11.1. Customers are solely responsible for maintaining independent backups of their data.
11.2. While SirWizTechHost may perform courtesy backups on certain shared hosting services, backup availability is not guaranteed.
11.3. SirWizTechHost shall not be liable for data loss under any circumstances.
11.4. Backup restoration requests may incur additional restoration fees.
12.1. Domain registrations, transfers, and renewals are subject to registry and registrar policies.
12.2. Customers are responsible for renewing domains before expiration dates.
12.3. Expired domains may enter redemption periods, auctions, or permanent deletion depending on registry rules.
12.4. SirWizTechHost is not responsible for losses resulting from expired domains, failed renewals, or incorrect WHOIS information.
13.1. Technical support is primarily provided through our official helpdesk and ticket system.
13.2. Live chat and telephone support are offered on a best-effort basis and may not cover advanced technical issues.
13.3. Reseller customers are responsible for supporting their own end users.
13.4. SirWizTechHost reserves the right to refuse abusive, threatening, or disrespectful communications.
14.1. Advanced administrative support outside standard hosting assistance may incur additional fees.
14.2. This may include malware cleanup, server optimization, software debugging, third-party application troubleshooting, migrations, or custom system administration tasks.
14.3. Customers will be informed before any advanced support fees are applied.
15.1. SirWizTechHost aims to provide 99.9% uptime for eligible hosting services.
15.2. Uptime guarantees do not apply to scheduled maintenance, third-party failures, customer-caused issues, attacks, or circumstances beyond our control.
15.3. Compensation for verified downtime, where applicable, shall be limited to service credits only.
16.1. Customers are responsible for maintaining secure passwords, software updates, and account security practices.
16.2. SirWizTechHost may suspend compromised accounts or services involved in spam, malware, phishing, or attacks.
16.3. Customers are responsible for all actions performed through their accounts whether authorized or unauthorized.
17.1. All services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind.
17.2. SirWizTechHost does not guarantee uninterrupted service, error-free operation, or absolute security.
17.3. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.
18.1. Under no circumstances shall SirWizTechHost be liable for indirect, incidental, special, punitive, or consequential damages including loss of profits, revenue, data, or business opportunities.
18.2. Maximum liability for any claim shall not exceed the amount paid by the customer for the affected service during the previous one (1) month.
19.1. Customers agree to indemnify and hold harmless SirWizTechHost, its employees, partners, affiliates, and service providers against all claims, liabilities, damages, losses, and expenses arising from:
Customer use of the Services
Violation of laws or regulations
Violation of intellectual property rights
Customer negligence or misconduct
20.1. This Agreement shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.
20.2. Any disputes arising from this Agreement shall fall under the jurisdiction of competent courts located in Lagos State, Nigeria.
21.1. SirWizTechHost shall not be liable for delays or failures caused by events beyond reasonable control including natural disasters, cyberattacks, wars, labor disputes, pandemics, government actions, power failures, or internet outages.
22.1. SirWizTechHost reserves the right to update or modify these Terms of Service at any time.
22.2. Updated versions will be published on our website and become effective immediately unless otherwise stated.
22.3. Continued use of the Services after changes constitutes acceptance of the revised Terms.
23.1. Customer information is handled according to our Privacy Policy.
23.2. SirWizTechHost does not sell customer personal information to unrelated third parties.
23.3. Customers acknowledge that certain data may be shared with registrars, payment providers, fraud prevention systems, or legal authorities where necessary.
